OVERVIEW

Welcome to The Core Company! "We", "us" and "our" refer to CORE FORM APPAREL Pty Ltd (ABN 24 696 087 635), the company behind The Core Company. We operate this store and website, including all related information, content, features, tools, products and services (the "Services"). The Core Company is powered by Shopify.

Core Notion Fitness personal training is provided separately by Cassie Netz trading as Core Notion Fitness Training (ABN 40 526 029 800). Personal training is not sold through this store, and these Terms don’t cover personal training services.

By using the Services, you agree to these Terms and our Privacy Policy.

SECTION 1 - AUSTRALIAN CONSUMER LAW

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the ACL or any other law that cannot be excluded. Where these Terms limit our liability, they only do so to the extent the law allows.

SECTION 2 - ACCESS AND ACCOUNT

By using the Services you confirm you are 18 or older, or are using them with the involvement of a parent or guardian. You agree that the information you give us is correct and current. You’re responsible for keeping your account login secure.

SECTION 3 - OUR PRODUCTS

We do our best to show our products accurately, but colours may look slightly different depending on your screen. Product descriptions may be updated from time to time. We may discontinue a product or limit quantities, for example during a sale.

SECTION 4 - ORDERS

When you place an order, you’re making an offer to buy. Your order is accepted when we confirm it by email. We may decline or cancel an order, for example if an item is out of stock, there’s an obvious pricing error or we suspect fraud. If we cancel an order after you’ve paid, we’ll refund you in full.

Returns and exchanges are handled under our Refund Policy and your rights under the ACL. Products are sold for personal use, not commercial resale.

SECTION 5 - PRICES AND PAYMENT

All prices are in Australian dollars and include GST. Shipping costs are shown at checkout before you pay. The price you pay is the price shown when you place your order. Prices and promotions may change, but changes won’t affect orders already accepted. Promotions may have their own terms, which will be shown with the promotion.

You agree to provide accurate payment details and confirm you’re authorised to use the payment method you choose.

SECTION 6 - SHIPPING AND DELIVERY

Delivery times are estimates, as set out in our Shipping Policy. We’re not responsible for delays outside our reasonable control, but if your order is lost or damaged before it reaches you, we’ll replace it or refund you. Risk in the products passes to you when they are delivered.

SECTION 7 - INTELLECTUAL PROPERTY

The content on the Services, including our names, logos, designs, text, images and videos, belongs to us or our licensors and is protected by Australian and international intellectual property laws. You may use the Services for personal, non-commercial use only, and must not copy or reuse our content or trademarks without our written permission.

SECTION 8 - THIRD-PARTY TOOLS AND LINKS

The Services may include tools or links provided by third parties. We don’t control them, so please review their terms and privacy policies before using them. To the extent the law allows, we’re not responsible for third-party websites, products or services.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

The Core Company is powered by Shopify, but any purchase you make is with us, not Shopify. Shopify is not responsible for sales between you and us.

SECTION 10 - PRIVACY

Personal information we collect is handled under our Privacy Policy. Some information is also handled by Shopify under the Shopify Privacy Policy.

SECTION 11 - REVIEWS AND FEEDBACK

If you send us reviews, comments, photos or ideas ("Feedback"), you allow us to use, display and share that Feedback on our website and social media, including with your first name and initial. We won’t use your photos, or name you in advertising, without your permission. Please keep Feedback honest and respectful, and only share content you have the right to share. We may remove Feedback that is unlawful, offensive or misleading, but we won’t remove genuine reviews just because they’re negative.

SECTION 12 - ERRORS

Sometimes information on the Services may contain errors, such as pricing or availability. We’ll correct errors as soon as we notice them. If an error affects your order, we’ll contact you and you can choose to continue or cancel for a full refund.

SECTION 13 - PROHIBITED USES

You must use the Services lawfully. You must not: break any applicable law; infringe our or anyone else’s rights; harass or harm anyone; send false or misleading information or spam; upload viruses or malicious code; scrape, copy or resell any part of the Services; use automated tools or AI agents to access the Services without identifying themselves; or try to get around our security measures. We may suspend or close an account that breaks these rules.

SECTION 14 - AGENTS

If you use an automated software agent to interact with the Services, it must identify itself as an agent in its requests, must not pretend to be a human or get around CAPTCHAs or other measures, and must stop if we ask it to. We may limit or block agent access.

SECTION 15 - TERMINATION

We may suspend or end your access to the Services if you seriously or repeatedly breach these Terms, or if we reasonably suspect fraud or unlawful use. This doesn’t affect orders already paid for, which we’ll fulfil or refund.

SECTION 16 - WARRANTIES

Other than the guarantees under the ACL and anything we expressly promise, we don’t give extra warranties about the Services. We aim to keep the website running smoothly but can’t promise it will always be available or error-free.

SECTION 17 - LIMITATION OF LIABILITY

Subject to Section 1, our liability for a failure to comply with a consumer guarantee for goods not of a kind ordinarily acquired for personal, domestic or household use is limited to replacing or repairing the goods, or paying the cost of doing so. To the extent the law allows, we’re not liable for indirect or consequential loss. Nothing in these Terms limits our liability for loss caused by our negligence, fraud or breach of the ACL.

SECTION 18 - INDEMNITY

You agree to cover reasonable losses and legal costs we incur because of your breach of these Terms or your unlawful use of the Services, except to the extent the loss was caused by us.

SECTION 19 - SEVERABILITY AND WAIVER

If any part of these Terms is found to be unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up.

SECTION 20 - ENTIRE AGREEMENT AND ASSIGNMENT

These Terms and the policies they refer to are the whole agreement between you and us about the Services. You can’t transfer your rights under these Terms without our consent. We may transfer ours, for example if the business is sold, as long as your rights aren’t reduced.

SECTION 21 - GOVERNING LAW

These Terms are governed by the laws of South Australia, and you and we submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth courts that sit there.

SECTION 22 - CHANGES TO THESE TERMS

We may update these Terms from time to time and will post the latest version on this page. Changes won’t apply to orders you’ve already placed. If we make a significant change, we’ll let you know.
